IN NO EVENT SHALL HANGRY JOE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR WEBSITE AND SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO HANGRY JOE'S IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if Hangry Joe's has been advised of the possibility of such damages. Some states do not allow the limitation or exclusion of liability for certain types of damages, so the above limitations may not apply to you in their entirety.

11. Indemnification

You agree to defend, indemnify, and hold harmless Hangry Joe's, its affiliates, officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

13. Dispute Resolution

We will attempt to resolve the dispute informally within thirty (30) days of receiving your written notice. YOU AND HANGRY JOE'S AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

13.4 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction.

14. Term and Termination

These Terms of Service shall remain in full force and effect for as long as you use the Hangry Joe's Website or services, or maintain an account with us.

We reserve the right to suspend or terminate your access to the Website and services at any time, with or without cause, and with or without notice, including but not limited to circumstances where:
